Order Acceptance: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
Payment Terms: Payment is due upon receipt of invoice unless other terms have been agreed upon in writing. We accept credit cards, checks, wire transfers, and cash on delivery (COD) for qualified customers. Late payments may be subject to interest charges of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less.
Credit Accounts: Credit terms are available to qualified customers upon approval. Credit applications must be completed and approved before credit terms can be extended.
Delivery Terms: Delivery dates are estimates only and are not guaranteed. Hennings Enterprises is not liable for delays in delivery caused by circumstances beyond our reasonable control.
Risk of Loss: Risk of loss and title for products pass to the buyer upon delivery to the carrier or upon pickup by the buyer, whichever occurs first.
Minimum Orders: Minimum order quantities may apply for certain products or delivery locations. Bulk delivery requires adequate access for delivery vehicles.
Inspection: Buyer must inspect products upon delivery and report any shortages, damages, or defects within 48 hours of delivery. Failure to report issues within this timeframe constitutes acceptance of the products as delivered.
Due to the nature of agricultural fertilizer products, returns are limited to the following circumstances:
Returns must be authorized in advance by contacting our customer service team. Unauthorized returns will not be accepted. Refunds will be issued to the original payment method within 14 business days of receiving and inspecting returned products.
Hennings Enterprises guarantees that our fertilizer products meet the nutrient content specifications stated on the product label and comply with all applicable federal and state fertilizer regulations.
Yield Guarantee: For customers who follow our recommended application rates and timing, we guarantee a minimum 15% yield increase compared to unfertilized controls, or we will refund the purchase price of the fertilizer. This guarantee is subject to:
This guarantee does not cover losses due to improper storage, application errors, adverse weather conditions, pest damage, or other factors beyond our control.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HENNINGS ENTERPRISES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF CROPS, OR LOSS OF BUSINESS, ARISING OUT OF OR RELATED TO THE USE OF OUR PRODUCTS OR SERVICES.
Our total liability for any claim arising out of or related to these Terms or the use of our products shall not exceed the purchase price paid for the products giving rise to the claim.
Buyers are responsible for the safe handling, storage, and application of all fertilizer products. Safety Data Sheets (SDS) are available for all products and should be reviewed before use. Buyers must:

Any disputes arising out of or related to these Terms or the use of our products or services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
